Drug Crimes Defense Lawyer
In today’s climate, all drug cases, no matter how minor, can significantly derail your life. Minor cases can result in you being passed over for a job or residence, while many felony drug cases can result in prison time. More and more, the police and prosecutors are taking a hard line on drug cases. Just because it has become politically popular to be tough on drugs doesn’t mean you should not be treated fairly. That’s where we come in. Nichols Law is dedicated to making sure that an overzealous government doesn’t trample on your rights, or that you aren’t denied the opportunity to receive treatment instead of jail time. If you’ve been arrested for a drug crime, you don’t have to face these charges alone. Nichols Law has the experience and compassion to help you through this.
Defending Against All Types of Drug Charges
Penalties for drug crimes can range from misdemeanor possession to felony trafficking, depending on the type of drug and the amounts at issue. Even low level drug cases can be complex. Most involve issues of whether a search was legal, whether the police advised you of your rights, or whether a drug was really in your possession instead of just close to you. If the police violate your rights, your case may be dismissed by the court. At Nichols Law, we use over 50 years of legal experience to uncover these violations to protect your rights and your freedom.
Addiction Treatment:
Drug Addictions are recognized diagnosed medical disabilities. If we don’t put people in jail for other medical problems, why do we continue to lock up people for drug addictions? At Nichols Law we fully recognize that some clients not only need help defending their criminal drug charges, but also with dealing with an on-going addiction that caused that criminal case. Our philosophy is simple: Sometimes it’s not enough to just deflect the criminal case… if there is a drug addiction, then let’s find a solution to that. In many cases, being involved in the criminal justice system turns out to be a blessing because it gives us a chance to address the real cause of the problem with a structured path to recovery. Don’t risk being locked up instead of taking the path that could save your life. We will fight to make sure you’re treated in an enlightened and compassionate manner… the same way we treat other medical issues.
Nichols Law handles every type of drug case, including:
- Trafficking a controlled substance
- Manufacturing a controlled substance
- Possession of a controlled substance
- Sale of a controlled substance
- Possession with intent to sell
- Importation of a controlled substance
- False prescription of a controlled substance
- False documents used to obtain a controlled substance
- Possession of drug paraphernalia
Whether you are accused of illegal sale of pain pills and opiates, possession of marijuana or cocaine, doctor shopping, or trafficking in harder drugs, you deserve the opportunity to defend yourself in court. At Nichols Law, we fight to ensure that our clients are not browbeaten into taking unjust plea bargains, and that the police followed all the rules when they made an arrest. We work with prosecutors and the courts to ensure that our clients are treated justly, with an eye toward rehabilitation rather than punishment. If there are holes in the prosecution’s case, we will work to see that your charges are reduced or dropped. If you need help with an addiction, we will do all we can to make sure you get the help you need. For a strong, compassionate, and effective legal defense to drug charges, you can rely on Nichols Law.
Marijuana Crimes in Florida
Many states around the country have decriminalized marijuana possession and sale for recreational use. Unfortunately, Florida has not yet joined them. Florida law still criminalizes even possession of small quantities of marijuana for personal use. As minor as this seems, these charges can still negatively scar your record. Employers or landlords may think you have a Drug problem and pass you over.
Under Florida law, possession of 20 grams or less of marijuana is a first degree misdemeanor, punishable by up to a year in jail, and 5 years in prison if the amount is more than 20 grams. Growing, trafficking, and selling marijuana are also serious as felonies in Florida, and can result in harsh penalties depending on the weight, the nature of the buyer, the location of the manufacture or sale, and whether the defendant maintains a drug property.
If you’re facing marijuana crimes, call the dedicated and effective cannabis defense team at Nichols Law for help. You may be eligible for a pretrial intervention program, designed to give first time offenders a way to eliminate their criminal charges without suffering the stigma of a criminal conviction.
Drug Courts, Pretrial Intervention, and Rehabilitation
Drug Courts recognize that society is better served by helping people suffering from an addiction rather than just locking them in a cage or staining their record for life. Participation in the drug court program usually results in the case being dismissed. The client participates in on-going drug treatment and appears for periodic status checks in drug court. Drug Court can truly be a fresh start: The case is dismissed, the addiction is treated, so the client can leave all those negatives behind them and is free to move on with their life. We are with you every step of the way!
Nichols Law embraces the chance to help a client who chooses that path. We will work to get you into the drug court program, and stay with you at your court hearings to help you achieve that goal of starting again fresh!
Call Nichols Law to learn if your case might be eligible for these alternative treatment programs. Remember, the primary goal of the justice system should be to help people live productive lives, rather than just punishing them for their addictions. Nichols Law is dedicated to that noble philosophy!
